These Terms of Service (“Terms”) govern your use of the website at trilliumservices.com and any related forms, emails, or text messages (together, the “Online Services”) provided by Trillium Diversified Services, LLC (“Trillium”), also referred to as TRILLIUM DIVERSIFIED SERVICES. By using the Services or submitting any form, you agree to these Terms and to our Privacy Policy located at https://trilliumservices.com/privacy. If you do not agree, do not use this website or request an estimate.

  1. Who We Are: Trillium provides Brick Paver, Concrete & Natural Stone Cleaning and Sealing, and Holiday Lighting & Decorating services for residential, commercial, and municipal clients.
  2. Relationship to Project/Job Contracts: Some work we perform is governed by a separate Contract Terms, Warranty & Service Agreement (“Service Agreement”). If these Terms conflict with the Service Agreement for a specific job, the Service Agreement controls for that project.
  3. Eligibility and User Responsibilities: 
    • You must be at least 18 years old to submit forms or provide consent to messaging.
    • You agree to provide accurate information and to have authority to represent the property or organization for which you request services.
    • Content you submit (including project photos) must not violate others’ rights or any law. You grant Trillium a limited license to use submissions solely to evaluate, quote, schedule, perform, invoice, and support services.
  4. Messaging Terms (SMS and Email):
    • Opt-in: By checking a consent box on our site or texting START to our number, you provide express consent to receive texts and emails about estimates, scheduling, project updates, reminders, notifications, account alerts, payment links, and occasional promotions. Message frequency varies.
    • Opt-out: Reply STOP to any text to end SMS communications. You may continue to receive transactional emails (e.g., invoices) as allowed by law.
    • HELP: Reply HELP for assistance; our automated assistant will provide Trillium-specific help.
    • Rates: Message and data rates may apply.
    • Not a condition: Consent to marketing texts is not a condition of purchase.
    • Accuracy: You confirm the mobile number you provide is yours and is kept current.
  5. Prohibited Uses: Anything that interferes with or disrupt the website or messaging systems; submit unlawful, harmful, infringing, or misleading content; attempt to reverse engineer, scrape, or access confidential information.
  6. Third-Party Services: We use trusted service providers to operate the Services (for example: PortalPro AI-driven CRM for SMS, email, web hosting and data security; Stripe and Authorize.net for payments; analytics/advertising platforms such as Google and Meta). These providers may process limited personal information solely to deliver their services to Trillium. See our Privacy Policy for details.
  7. Disclaimers: The website and all online materials are provided “as is” and “as available.” To the maximum extent permitted by law, Trillium disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. On-site service performance, warranty terms, installation/removal windows, GFCI/electrical limitations, weather delays, and similar job-specific issues are governed by the Service Agreement for your project.
  8. Limitation of Liability: To the maximum extent permitted by law, Trillium and its owners, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, loss of data, personal injury, or property damage, even if advised of the possibility. Our total liability relating to the Services is limited to the greater of one hundred U.S. dollars ($100) or the amount you paid to us in the three (3) months before the claim.
  9. Indemnification: You agree to indemnify and hold Trillium harmless from claims arising out of your misuse of the Services, your submissions, or your violation of these Terms or applicable law.
  10. Dispute Resolution; Governing Law; Venue: These Terms are governed by Michigan law. Except for actions to collect unpaid amounts due (which may be brought in any court of competent jurisdiction), any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association in Oakland County, Michigan. You and Trillium agree to arbitrate on an individual basis only and waive any right to a jury trial or to participate in a class action.
  11. Changes to These Terms: We may update these Terms. When we do, we will revise the Effective Date above and post the updated version on this page.
